Privacy policy

This policy explains what happens to your data when you use this site. It is written in plain language on purpose. If anything is unclear, write to us and we will explain.

Futuro Recente develops and sells the homes it builds. It is not an estate agency.

2. Talking to us about privacy

For anything to do with your data, write to [email protected]. We reply within one month.

We have no Data Protection Officer, because the law does not require us to appoint one.

3. What we collect

We collect data when you give it to us:

  • Contact form: name, phone with country dialling code, email, the type of home you are looking for and any message you write.
  • Direct contact: if you write or call using the details published on the site, we keep what you tell us.

We use no audience measurement tools and we do not follow your browsing. There is no Google Analytics, no Facebook pixel and no advertising.

As on any website, servers record technical data on their own: IP address, date and time of access. This keeps the site working and secure, it is not used to identify you, and it is not cross referenced with your enquiry to build any profile.

We do not buy contact lists from anyone.

4. What it is for, on what basis and for how long

Answering your enquiry
Our legitimate interest in replying to people who approach us (Art. 6(1)(f) GDPR) and, once you enter negotiations with us, the pre-contractual steps you ask of us (Art. 6(1)(b)). We keep it while the matter is live and, as a rule, delete it after 24 months without any contact from you.
Keeping the site running
Our legitimate interest (Art. 6(1)(f)). Technical logs kept for a short period, for this purpose only.
Meeting legal duties
Legal obligation (Art. 6(1)(c)). For the periods the law sets, for example ten years for tax purposes where a contract exists.

If one day we want to send you information about our other developments, or call you using an artificial intelligence assistant, we will ask your permission first, in a separate tick box. We do neither today.

5. Which details are needed

The form asks for your name, phone, email and the type of home you are looking for, and all of those are required. We ask for both phone and email because in property the answer almost always comes by phone, and email is how we send plans and documents that do not fit into a call. The message is optional.

If you would rather not give one of these, call or write to us directly using the details in section 1, and we will reply with whatever you are happy to give us.

6. About the message box

The message box is free text and comes straight to us. One favour: please do not write health details, family matters or other sensitive subjects there. We do not need them to reply to you and it is not the right place to keep them.

7. Who has access to your data

We do not sell your data. We do not pass it to anyone for third party marketing.

But it would be dishonest to stop there, because your data does pass through companies that work for us.

The system that receives, stores and forwards contact requests was built and is operated by Mateus Svartz, the provider who made this site. That is where the record of your enquiry is kept, in a file with restricted access. To run it, that provider uses third party services:

  • A server the system runs on, hosted in the European Union.
  • Spreadsheet and email services, to record the enquiry and send the notification.
  • A hosting and delivery service for this site's pages.

Within Futuro Recente, your enquiry reaches the office and the sales team, who deal with it and reply to you.

If a court or an authority requires data from us by law, we have to hand it over. Outside those cases, your data is not shared with anyone else.

8. Transfers outside the European Union

Some of the providers above are based outside the European Union and may process data in the United States. The server the contact system runs on is in the European Union.

These transfers rely on the mechanisms in Chapter V of the GDPR: the European Commission's adequacy decision for the United States, where the provider is covered by it, or the standard contractual clauses approved by the Commission.

If you want to know these providers by name, and which safeguards apply to each, write to [email protected] and we will give you that list and tell you where to obtain a copy of the safeguards, under Article 13 GDPR.

9. Phone calls

As at the date of this policy, a person calls you. We make no automated calls, we use no artificial intelligence assistants on the phone, and we neither record nor transcribe calls.

We are preparing a call back service run by an artificial intelligence assistant, for enquiries that arrive outside office hours. That service will only start once:

  • We ask you, in the form, for separate permission that is not pre ticked.
  • The assistant says, in its first sentence, that it is an artificial intelligence assistant and not a person.
  • We tell you, at the start of the call, whether it will be recorded or turned into text, what that is for and how long it is kept.
  • This policy is updated with everything that becomes true.

You can always ask to speak to us without recording or transcription, and you can always ask to speak to a person.

10. Automated decisions

We take no automated decisions with legal effects or that significantly affect you, and we build no profiles. A person reads your enquiry and decides what happens next. If that changes, we will say so here.

11. Your rights

If we send you information about other developments, you can tell us at any time that you no longer wish to receive it, without giving a reason, and we stop immediately.

In addition, regarding the data we hold about you, you can:

  • Access it: find out what we hold and ask for a copy.
  • Correct it: have anything wrong or incomplete put right.
  • Erase it: ask us to delete it, where the law does not require us to keep it.
  • Restrict it: ask us to keep it but not use it, while some question is resolved.
  • Object: object, on grounds relating to your particular situation, to processing based on our legitimate interest.
  • Take it with you: receive the data you gave us in a file you can hand to another company.
  • Withdraw consent, where processing is based on it. Withdrawing does not make unlawful what we did beforehand.

To exercise any of these rights, write to [email protected]. We reply within one month. If the request is complex and we need longer, we will tell you within that month.

If we have reasonable doubts about the identity of the person making the request, we may ask for further information, to make sure the data does not reach the wrong person (Article 12(6) GDPR).

12. Complaints

If you think we have not handled your data properly, tell us first and we will try to sort it out. But you can always complain to the Portuguese authority:

13. Security

Access to contact requests is limited to the people and services that need it for the work described in this policy.

If there is a security breach that may affect your data, we will notify the CNPD within the legal deadlines and, where that breach is likely to result in a high risk to you, we will notify you as well.

14. Minors

This site is not aimed at anyone under 18 and we do not knowingly collect data from minors. If we learn that we have received data from a minor without the permission of whoever represents them, we delete it.

15. Changes

This policy carries the date of its last update at the top. If we change anything important, such as starting to use the artificial intelligence assistant or adding a new provider, we will update this text. Where the change depends on your permission, we will ask for it before putting it into practice.
